Use of copyright material

Postby Sharon » Tue May 16, 2006 9:44 am

When posting material on the forums could all users please remember that when sourcing images from the web they will be subject to copyright. So please check the terms of use before posting such images.

I have been contacted by SCRAN who have asked me to ensure that users do not post images from their website as it is a breach of their distribuition liscense.

It has come to our attention that a number of Images from the SCRAN Website http://www.scran.ac.uk are being posted on your website. Scran is an authenticated website for which users must sign up to licence terms before receiving a user name and password. The images are all licenced to Scran by the participating institutions and companies. A specific condition of use is that such images may not be distributed in any way by users to unlicenced users. It is also a fundamental condition of use that all legitimate use should be accredited. This is because a large number of images are in copyright and in some cases belong to commercial operators.

Please consult http://www.scran.ac.uk/info/copyright.php for our terms which all legitimate users must sign up to.

Beat me to it glasgowken. They've received loads of members via this site. What a bunch of bloody dullards. If the copyright notice is retained on the images where is the harm? Scran, if you're reading this... you can shove your membership renewal where the sun don't shine as far as i'm concerned.

The problem they might have is that they are themselves using the images under license with terms and conditions attached?

But I do wonder how many memebers they have had from HG!!!

Using Wiki as an example. Having a look at the link below.

http://en.wikipedia.org/wiki/Image:BladeRunner_Sun.jpg

How do we know if copyright has already been breached
by a previous uploader.

From Wiki

This image is a screenshot from a copyrighted film, and the copyright for it is most likely owned by the studio which produced the film, and possibly also by any actors appearing in the screenshot. It is believed that the use of a limited number of web-resolution screenshots

Will they inform us when the "limited number" as been exceeded?

I think they're shooting themselves in the foot over this. It wouldn't do them any harm to use some discretion.

Fair enough if some bawbag tries to sell the images, then take action, but a handfull of images on a no profit, educational site is for the greater good.

Education for the masses, and all that....

I can understand not using someone's photos from modern times. Someone who is alive and well. What I resent is these blawhards telling me not to use photos taken 120 years ago in this fine city.

They can say they own those photos. Do they fuck. If Thomas Annan could talk I bet he'd love to know his work is enjoyed all over the world. We on HG use those photos as I'd guess they were meant to be used. To educate, illuminate and fascinate. When you look at the subject matter of some of the old stuff it's quite clear these were photographed by people who cared about people and communities. They'd turn in their feckin graves if they thought their work was being curtailed.

The thing is they are not saying they own the images - they themselves are using them under licence from others. Which may be the problem.
